Effective September 11, 2020, in addition to the vehicle arbitration rules set forth in Manheim Terms and Conditions, this Addendum to the 2017 NAAA Arbitration Policy applies for digital sales transacted through OVE.com (“Addendum”). In the event of a conflict between the vehicle arbitration rules set forth in the Manheim Terms and Conditions and those set forth in this Addendum, this Addendum will control.

Special Arbitration Procedures for OVE

Sale Light System OVE does not operate with a sale light system. All Vehicles are considered to be “Ride and Drive” unless specifically noted as “As Is”. Vehicles selling “As-Is” will only qualify for arbitration under the rules outlined in the Arbitration Guidelines section of Manheim Arbitration Policy. Any Vehicle that sells for $3000 or under is considered As-Is and can only be arbitrated for conditions outlined in the Appendix I.A to this Addendum.
Seller Responsibilities
1. The Seller understands that the online listing and disclosures are a binding arbitration representation of Vehicle condition by Seller. Seller is therefore responsible for ensuring that their Vehicles are listed accurately regardless of disclosure requirements in Appendix I.A.
2. Seller must disclose all Vehicle specifications, equipment, announcements, and defects (condition information) in the designated fields with additional explanation in the “seller comments” field. Disclosures made only in “seller comments” without notation in the appropriate field do not exempt the Vehicle from arbitration.
3. If announced as Title Present, Seller must provide title within 3 business days of the sale unless state law specifies a different time period. If announced as Title Attached/Title Unavailable/Title Absent, Seller must provide title within 30 calendar days unless state law specifies a different time period. In all cases, Sale day is Day 1.
4. Seller must make the Vehicle available at stated pickup location within 3 business days of sale date. In addition to other remedies, (i.e., OVE may unwind the transaction), Seller may be assessed up to a $500 fee to compensate buyer for each sale not fulfilled, as stated in Section 34(a)(v) (Vehicle Availability “Unbuy” Policy) of the Manheim Terms and Conditions.
Additional Buyer Responsibilities:
1. For vehicles purchased but not made available by the Seller at the stated pickup location within 3 business days of sale date, Buyer has up to 14 calendar days to arbitrate the vehicle and be eligible for compensation credit up to $500, as stated in Section 34(a)(v) (Vehicle Availability “Unbuy” Policy) of the Manheim Terms and Conditions. In all cases, Sale day is day 1.
Arbitration Guidelines:
1. Time Period
  Buyer must initiate any vehicle arbitration within 14 calendar days unless a longer period is allowed as noted in Appendix I.A for arbitration time periods. Sale day is Day 1. Arbitration shall end at the close of business on the last calendar day in the time period.
2. Process

Any vehicle with an undisclosed single defect as outlined in Appendix I.A that has a repair cost of $400 or more or multiple defects with cumulative cost of $800 or more is subject to arbitration.
